01Agreeing to these terms
These terms cover your use of this website and how we work with clients. By browsing the site or hiring Div Enclave, you agree to them. If you do not agree, please do not use the site.
If you are agreeing on behalf of a company, you confirm that you have the authority to commit that company.
Your signed quote or statement of work spells out the details of your specific project. Where your quote and these terms say different things, the quote wins for that project.
02What we do
Div Enclave provides digital design and development services, including:
- Business websites and landing pages
- Web applications and internal business tools
- CMS and ecommerce builds, such as WordPress, Shopify, WooCommerce and headless CMS
- Mobile apps
- UI and UX design
- AI and workflow automation
- Maintenance, support and technical consulting
The scope, deliverables, timeline and price for your project are the ones written in your quote.
03How a project starts
- You send an enquiry through this website or by email.
- We talk through what you need, then send you a written quote.
- You approve the quote and pay the 40% deposit.
- We book your project into our schedule and get to work.
Work only begins after the deposit clears. Until that happens, your slot is not reserved, so dates can move.
04What we need from you
Projects move at the speed of your feedback. To keep things on schedule we ask for:
- Your content in reasonable time: text, images, logos, product data.
- Access we need: hosting, domains, admin logins and third-party accounts.
- Answers to our questions and feedback on drafts within the agreed review window.
If we do not hear from you for 30 days in a row, the project goes on hold. Picking it up again may need new dates and a re-scheduling fee, because your original slot gets filled by other work.
05Pricing and payment
- Prices in your quote are valid for 30 days from the date we send it.
- We only start the project after the quote is confirmed and the required 40% advance payment has been received.
- The remaining balance is paid according to the milestones or delivery schedule outlined in your quote.
- Invoices are due within 7 days, unless different payment terms have been agreed upon in writing.
- Any bank transfer fees or currency conversion charges are the client's responsibility.
- If an invoice remains more than 10 days overdue and we are unable to reach you, work may be paused until the outstanding amount is settled.
Payment Security
We understand that making an advance payment to an online company can feel like a big step. Divenclave is a legitimate, properly registered company, and our company registration documents and relevant certifications can be provided for verification upon request before you enter into any agreement with us.
You can also review our client feedback, reviews, and previous work to learn more about our experience and the work we have delivered.
For additional peace of mind, our proposal, terms, and conditions clearly outline our refund policy. Where a refund is applicable under the agreed terms, you can submit a refund request through a straightforward process.
We want the payment arrangement to be clear, transparent, and fair for both sides before we begin your project.
06Revisions and extra work
Your quote states how many revision rounds are included. Within those rounds, we will keep applying your feedback until you are happy with the result.
Changes that grow the scope, add pages or features that were not in the quote, or come after you signed off count as extra work. We always send a separate price for that first, so you never get a surprise bill.
07Who owns what
Once the final invoice is paid, the finished deliverables are yours: the custom design, the code we wrote for your project, and the content you provided.
Some things stay with us: frameworks, libraries, reusable code and internal tools that we built before your project or reuse across projects. You get a licence to use them as part of your website for as long as you run it.
Third-party items like fonts, themes, plugins and stock media keep their own licences. If any of them need your own account or an ongoing fee, we tell you up front.
We enjoy showing our work. We may feature your project in our portfolio and case studies unless you ask us not to in writing. A signed NDA also keeps everything off our site.
08Third-party services
Domains, hosting, paid plugins, stock images and external APIs usually sit under your own accounts, so you keep full control. Their terms and fees apply on top of ours. If a provider changes something that breaks your site later, fixing that falls under support or maintenance, not the original build.
09Support after launch
If something we built has a genuine defect, tell us and we will fix it. Every project comes with a support window after launch; the exact length is written in your quote.
Ongoing maintenance, software updates and new features are separate services. We are not responsible for problems caused by third-party outages, hacking, or changes that you or someone else makes to the site after handover.
10Warranties
We carry out our work with care and to professional standards. Beyond that, the website and our services are provided "as is" to the extent the law allows. We cannot guarantee search rankings, sales, or uptime for things that depend on services outside our control.
11Limitation of liability
To the fullest extent the law allows, we are not responsible for indirect or consequential losses, such as lost profits, lost data or lost goodwill, that come from using our services.
Our total liability for any project is limited to the amount you paid us for that project. Nothing in these terms limits liability that cannot be limited by law.
12Cancelling a project
You can cancel at any time by writing to us. When you do, you pay for the work completed up to that date, plus any third-party costs we have already committed to on your behalf. Milestones we have not started are not charged.
Our Refund Policy explains exactly how the money works out in each situation.
13When we may end an engagement
We may pause or stop a project if invoices stay unpaid, if the scope keeps growing without agreement, or if conversations become abusive toward our team. In that case you pay for the work completed, and we hand over the finished parts once we are paid for them.
14Confidentiality
Your business information, files and ideas stay private. We only share them with team members and tools that need them to do the work. If you send us a non-disclosure agreement, we are glad to sign it.
15Governing law
These terms are governed by the laws of Pakistan. Before anything formal happens, please talk to us; a conversation solves most issues. If we still cannot agree, the courts of Karachi, Pakistan have jurisdiction.
16Changes to these terms
We may update these terms from time to time. New versions appear on this page with a fresh date at the top. Using the site after an update means you accept the new terms.
